Rental terms

1. Who we rent to

LAB37 rents only to companies and other businesses with a company registration number (the renter). The person who books and accepts these terms confirms that they are authorised to act for the renter.

2. Personal liability

The person who accepts these terms on behalf of the renter is personally liable, jointly and severally with the renter, for all of the renter's obligations under the agreement, as if they were their own debt.

3. Agreement and acceptance

The agreement is made when the renter accepts these terms in the booking. The acceptance is recorded with its time and the version of the terms, and counts as a signature. Changes and additions must be in writing; email is enough.

4. Payment

Rent is paid in advance by card before the equipment is handed over. Payment by invoice applies only where LAB37 has agreed to it in writing, and is then due within 10 days of the invoice date. Fees and compensation under these terms are invoiced and due within 10 days. Late payment carries interest under the Swedish Interest Act (räntelagen) and the statutory reminder fee. All prices are stated excluding VAT, and VAT is added at 25 percent. Businesses established outside the EU are not charged Swedish VAT.

5. Handover, identity and inspection

Unless agreed otherwise, the equipment is collected from and returned to Solnavägen 37B in Solna. At handover or delivery, the renter or their representative must show valid photo ID, and LAB37 may record the ID document number. The renter must check the condition and function of the equipment at handover and point out any fault or damage before accepting it. Equipment accepted without remark is taken to have been received in good working order.

6. Delivery and collection

LAB37 can deliver and collect within greater Stockholm for a fee of 400 SEK per journey, 800 SEK for both. On rentals of 4,000 SEK or more one journey is free, and from 8,000 SEK both are. The amounts refer to the equipment rental excluding VAT, before any discount. A journey booked before 09:00 or between 15:00 and 18:00 costs 400 SEK extra, including a journey that would otherwise be free. Someone able to show ID must be there at the agreed time.

7. Rental period and late return

The rental period runs from the agreed handover time to the agreed return time. Equipment returned late is charged at twice its one-day price for each started day. LAB37 may have closed periods, for example holidays. They are shown in the booking calendar and cannot be booked.

8. Use

The equipment may be used by the renter and their crew on the production, and the renter is responsible for them as for themselves. It may not be rented out, lent or transferred to anyone else, and may not be taken out of Sweden. It must be handled competently and never left unattended. The equipment belongs to LAB37.

9. Risk

The renter bears the risk of loss of or damage to the equipment, whatever the cause and whether or not anyone is at fault, from handover until LAB37 has received and approved the return. Normal wear is not damage.

10. Compensation for damage and loss

For loss, theft or damage that cannot be repaired, the renter pays the equipment's replacement value: what it costs LAB37 at the time to buy equivalent new equipment. For other damage, LAB37 decides whether the renter pays the cost of repair as assessed by LAB37 or the replacement value. Compensation is invoiced at once and does not wait for a repair, an insurance decision, a police report or any other investigation. Until the compensation is paid, the one-day price of the damaged or lost equipment is charged for each day. Damaged equipment remains LAB37's property. The renter must tell LAB37 of any damage or loss immediately and report theft to the police.

11. Insurance

LAB37 does not insure the equipment, nor anything the renter does with it. The renter must hold insurance covering the equipment's replacement value and any injury or damage to property that its use may cause. Missing or insufficient insurance does not reduce the renter's liability.

12. Damage to others

The renter is liable for any injury or damage to property arising from the use of the equipment, and must indemnify LAB37 against any claim made against LAB37 for such injury or damage.

13. Cleaning

Equipment returned dirty is charged a cleaning fee of 500 SEK excluding VAT.

14. Cancellation

Cancellation is free up to 48 hours before the rental starts. Later cancellations are charged 50 percent of the rent. If the equipment is not collected and the booking was not cancelled, the full rent is charged.

15. LAB37's right to refuse and to end the rental

LAB37 may refuse a handover or cancel a confirmed booking before handover without giving a reason, and then refunds everything paid. The renter is not entitled to any other compensation. If the renter breaches these terms, LAB37 may end the rental at once and collect the equipment at the renter's expense, and the rent for the full agreed period remains payable.

16. LAB37's liability

If the equipment does not work and the fault is not the renter's, LAB37 replaces it where possible. Otherwise LAB37 refunds the rent for the days affected. That is LAB37's only liability. LAB37 is never liable for lost production, reshoots, crew costs, lost profit or any other indirect loss, nor for delays or failed deliveries caused by circumstances beyond its control.

17. Governing law and disputes

These terms are governed by Swedish law. Disputes are settled by the Swedish courts, with Solna District Court (Solna tingsrätt) as the court of first instance.
